2. Scope

This Policy applies to visitors of our website, sales pages, and users of the Juan Social app ("Service"). It's written to address obligations under:

• The Australian Privacy Act 1988 and Australian Privacy Principles (APPs)
• The UK General Data Protection Regulation and Data Protection Act 2018
• The EU General Data Protection Regulation (GDPR)
• The California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA)

Where obligations differ by region, we note the relevant right below rather than applying the strictest standard universally, so you can identify which rights apply to you.

3. Who Can Use Juan Social

Juan Social is a business-to-business (B2B) service. It is intended for business owners and operators acting in a business capacity, not for consumers. We do not knowingly collect information from individuals under 18, and we do not collect age-related data as part of normal operation — accounts are not screened or policed for age, as the Service is not directed at or marketed to minors.

4. What We Collect

Account & Business Information

• Email address (for account access and communication)
• Payment information (processed by Stripe — see Section 6; we do not store full card details ourselves)
• Business logo (uploaded and stored to apply your brand kit)
• Website URL and the brand voice/tone profile derived from scanning it

We do not collect phone numbers or physical address details as part of account signup.

Content You Provide (Session-Based)

• Reviews, comments, or custom text you paste into the tool
• Background images you upload for graphics
• Customization choices (colors, sliders, template selections)

This content is processed to generate your reply, caption, or graphic and is not stored persistently beyond your active session, except for your logo and brand voice profile, which are saved to your account so your brand kit applies automatically each time you use the Service.

Usage & Technical Data

• Log data, device/browser information, and general usage analytics via Google Analytics and Google Search Console
• Advertising identifiers via Meta Pixel, Google Ads tag, TikTok Pixel, and Pinterest Pixel (see Section 7)

5. How We Use Your Information

We use your information to:

• Provide and operate the Service (generate replies, captions, and graphics)
• Apply your saved brand kit (logo, brand voice) automatically
• Process payments and manage your subscription/credits
• Send transactional and marketing/promotional communications via email (see Section 8)
• Analyze and improve the Service (via Google Analytics/Search Console)
• Measure and optimize advertising performance (via Meta, Google, TikTok, and Pinterest pixels)
• Comply with legal obligations

6. Third-Party Processors & AI Providers

We share limited data with the following categories of service providers, each acting as an independent data processor/controller for their own systems:

AI Reply & Caption Generation: Content you submit for reply/caption generation (e.g., pasted reviews, your brand voice profile) is sent to one or more of the following AI providers depending on which model is in use at the time: Anthropic (Claude), OpenAI, and/or Google (Gemini). These providers process this content under their own privacy policies and terms. We encourage you to review:

• Hosting & Backend: Base44 (application hosting and backend infrastructure)
• Payments: Stripe (payment processing — Stripe's own privacy policy governs card data handling)
• Analytics: Google Analytics, Google Search Console
• Advertising: Meta Pixel, Google Ads tag, TikTok Pixel, Pinterest Pixel (see Section 7)
• Email Marketing: GoHighLevel (GHL) — used for email communications only, not SMS

We may add additional service providers (e.g., further analytics tools) as the Service develops. Material changes will be reflected in updates to this Policy.

We do not sell or share your personal information with third parties for their own independent marketing purposes.

7. Cookies & Advertising Pixels

We use tracking pixels from Meta, Google, TikTok, and Pinterest on our sales pages, offer pages, and (where applicable) blog pages to measure ad performance and show you relevant ads on those platforms. These pixels may set cookies or use device identifiers.

• EU/UK visitors: We will present a cookie consent mechanism before non-essential cookies (including advertising pixels) are activated, in line with GDPR and PECR/UK PECR requirements. You may withdraw consent at any time.
• California visitors: Use of these advertising pixels may constitute "sharing" of personal information under the CPRA for cross-context behavioral advertising purposes. You have the right to opt out — see Section 9.
• Australian visitors: We rely on the APPs' notice and consent framework; pixel-based advertising will be disclosed at the point of collection.

No personal information collected via these pixels is sold. Pixel data is used solely for advertising measurement and retargeting.

8. Marketing Communications

If you provide your email address, we may send you marketing and promotional communications via GoHighLevel (GHL) regarding Juan Social features, offers, and updates. You can unsubscribe at any time using the link provided in any marketing email. Transactional emails (e.g., receipts, account notices) are not affected by marketing unsubscribes.

We do not use SMS/text messaging for marketing at this time.

9. Your Rights

Depending on your location, you may have the right to:

• Australia (Privacy Act / APPs): Access your personal information, request correction, and lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe we've mishandled your data.
• UK/EU (GDPR): Access, rectify, erase, restrict, or port your data; object to processing (including for direct marketing); and lodge a complaint with your relevant supervisory authority (e.g., ICO in the UK).
• California (CCPA/CPRA): Know what personal information is collected; request deletion; opt out of "sale or sharing" (including for cross-context behavioral advertising via ad pixels); and non-discrimination for exercising these rights.

10. Data Retention

• Account information (email, brand kit, logo, brand voice profile): retained while your account is active, and for a reasonable period after closure for legal/accounting purposes
• Session-based content (pasted reviews, uploaded backgrounds, generated outputs): not retained beyond your active session
• Payment records: retained per Stripe's and our own accounting/legal obligations

11. Data Security

We take reasonable technical and organizational measures to protect your data, relying on the security infrastructure provided by Base44 (hosting) and Stripe (payments). No method of transmission or storage is 100% secure.

12. International Data Transfers

As our infrastructure and AI providers operate globally (including the US), your data may be transferred outside your country of residence. Where required (e.g., for UK/EU users), we rely on appropriate safeguards such as Standard Contractual Clauses or equivalent mechanisms provided by our processors.

13. Changes to This Policy

We may update this Policy from time to time. Material changes will be reflected with a new "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
